Diligencia de embargo

A diligencia de embargo is an AEAT enforcement notice identifying the asset, right, or payment stream being attached to collect an unpaid tax debt.

Definition

It follows when a debt remains unpaid in executive collection. The notice may concern money in an account, credits or payments owed by a third party, securities, salary or pension, property, or another asset. Read whether it is addressed to you as the debtor or to a third-party payer, which asset or payment it identifies, the amount, and the instructions. Opposition grounds are limited, and the notice states the available route and period; do not assume every diligencia freezes a bank account or that the recipient is always the debtor.

  • Identify the asset, right, credit, salary, property, or payment stream named in the notice.
  • Check whether the document addresses the debtor or a third-party payer who owes money to the debtor.
  • Use the embargo-specific AEAT source and the notice before paying, replying, or challenging.

Example: a customer that owes money to the debtor can receive a credit-embargo notice as a third-party payer. That is a different role and workflow from receiving a bank-account embargo as the debtor.
