Definition
Tax penalties depend on the specific infringement and circumstances. Not every late filing produces a sanction: a voluntary late return without a prior administrative request can instead fall under the surcharge rules. Reductions are separate and conditional: for sanctions under Articles 191–197, Article 188 provides 30% for conformity, while a separate 40% reduction of the remaining sanction requires the stated payment and no-appeal conditions; actas con acuerdo use a different reduction. A tax sanction may be challenged independently through reposición or an economic-administrative claim, and a timely administrative challenge suspends its execution in the terms set by law.
